This course is an introduction to the law governing all aspects of construction projects. We will examine the duties and liabilities of the participants in the design and construction process: the owner; the construction manager; the architect; the engineer; the general contractor; subcontractors; construction lenders; and sureties. The topics covered will include: the bid process; bid protests; the design and construction contracting process, with an emphasis on standard industry forms and key contract provisions; performance problems; contract completion and delay damages; default and termination; payment and performance bonds; and mechanics' liens. We will discuss construction litigation and arbitration and how attorneys can seek to avoid disputes during the negotiation and drafting of contract terms.
